Am Montag, den 14.03.2016, wurde Zaki nach 6 Wochen Haft in der Abschiebehaftanstalt JVA Mühldorf und 3 Wochen im Hungerstreik nach  Afghanistan abgeschoben.

Folgendes Statement & Zusammenfassung haben wir nach der Abschiebung  gemeinsam mit Zaki bei Telefonaten zwischen Deutschland und Afghanistan  verfasst. Wir freuen uns, wenn es verbreitet und veröffentlich wird.

This is racism: Freedom is just for you. I will not stop to fight for freedom. It does not matter if you are black or white, because freedom is for all the people. We are not criminal, not Taliban, we don’t do anything to somebody. It is not for my self interest. Racism destroys also the future of young generations. If they don’t deeply unterstand, it is very dangerous.“

Zaki befand sich seit dem 01.02.2016 in der Abschiebehaftanstalt in  Mühldorf am Inn, nachdem das Standesamt Tirschenreuth seinen afghanischen Pass an die Ausländerbehörde weitergegeben hatte.

Am 08.02.2016 fand bereits ein erster Abschiebeversuch mit Qatar Airlines vom Flughafen München aus statt, welcher unter Protest am Flughafen und von Zaki selbst gestoppt wurde.

Am 15.03.2016 wurde Zaki, obwohl ein fachpsychologisches Gutachten über eine schwere Erkrankung vorlag, und obwohl er seit über 3 Wochen nichts mehr gegessen hatte, nach Afghanistan abgeschoben. Trotz dieser lebensgefährlichen gesundheitlichen Situation und spontanem Protest am Frankfurter Flughafen bei der Airline, führte Air India die Abschiebung aus.

Zaki wurde abgeschoben, obwohl er seit 3 Jahren versucht, seine Verlobte, welche norwegische Staatsbürgerin ist, zu heiraten. Obwohl er Vater zweier Kinder ist, welche in Norwegen leben. Obwohl er seit 14 Jahren in Europa lebt. Obwohl er integriert ist, Deutsch, Norwegisch und Englisch spricht und keine Vorstrafen hat.

Bis zum Schluss hat das Gericht die Ehefähigkeit bzw. Ledigkeit von Zaki nicht anerkannt. Diese war durch zahlreiche Dokumente von norwegischen und afghanischen Ämtern und Aussagen von Freunden und Zaki selbst eindeutig bewiesen. Das Gericht ignorierte diese Beweismittel schlichtweg. Hier zeigt sich  der politische Wille, Abschiebungen nach Afghanistan rücksichtslos durchzuführen und sich dabei selbst über geltendes Recht zu erheben: das Grundrecht auf Schutz der Ehe und Familie sowie rechtsgültige Abschiebungshindernisse wie Krankheiten.

Am 09.03.2016 entschied der Petitionsausschuss im Bayerischen Landtag gegen die Stimmen der bayerischen Grünen und SPD, keine Aufenthaltsduldung für Zaki mehr zu erteilen. Ausschlaggebend war wohl das Argument, dass er „illegal“ und angeblich unter „falscher Identität“ nach Deutschland eingereist sei. Die Tatsache, dass es kaum legale Fluchtmöglichkeiten nach Europa gibt, und so die große Mehrheit der Geflüchteten gezwungen ist, „illegal“ einzureisen, war der Mehrheit des Petitionsausschusses offensichtlich noch nicht zu Ohren gekommen.

Seit dem 21.02.2016 war Zaki im Hungerstreik. Ein weiterer Hungerstreikender wurde bereits am 24.02.2016 nach Afghanistan abgeschoben. Am Tag vor seiner Abschiebung war ein Feuer in seiner Zelle ausgebrochen. Auch diese Abschiebung konnte trotz Protest bei der ausführenden Airline Air India in Frankfurt, des hohen gesundheitlichen Risikos aufgrund des Hungerstreiks und der Rauchvergiftung, nicht gestoppt werden.

Die JVA Mühldorf hatte seit dem Brand in der JVA ein allgemeines Besuchsverbot ausgesprochen. Zudem bestand eine Postsperre. Zaki erhielt  die Post seiner FreundInnen und UntersützerInnen auch bei der Abschiebung nicht, obwohl die Beamten der JVA ihm dies zugesagt hatten: Sie händigten ihm nur leere Umschläge aus.

Aufgrund des Hungerstreiks und der Abschiebungen hatten verschiedene Protestaktionen stattgefunden: Am 26.02. hatten sich Anti-AbschiebungsaktivistInnen den Eingangsbereich des Ausländeramts in München besetzt, sich angekettet und einen sofortigen Stopp der Abschiebungen gefordert. Am 01.03.2016 fand eine Solidaritätskundgebung an der JVA Mühldorf statt. Zaki erzählte uns, er sei in ein anderes Zimmer gebracht worden, damit er nicht mit den Menschen auf der Kundgebung kommunizieren konnte.

Obwohl eigentlich für Abschiebehäftlinge erleichterte Haftbedingungen gelten, da hier der „Strafcharakter“ der Haft wegfällt, wurden den Geflüchteten durch das Besuchsverbot und die Postsperre ihre grundlegenden Rechte willkürlich verwehrt. Die JVA verunmöglichte dadurch Zugang zu sozialer und rechtlicher Beratung, sowie den Kontakt mit der „Außenwelt“.

Dieses harte Vorgehen, aufgrund von friedlichem Protest in Form eines Hungerstreiks ist nicht nur unmenschlich, sondern unserer Meinung nach auch rechtswidrig.

Mit der Abschiebung von Zaki, der sich seit 23 Tagen im Hungerstreik befand, setzen die Behörden zudem seine Gesundheit und sein Leben aufs Spiel.

Nicht zuletzt ist auch die allgemeine Situation in Afghanistan weiter lebensgefährlich!

Freedom of movement is everybody’s right! Kein Mensch ist illegal!

After 6 weeks of detention and 3 weeks of hunger strike in the detention centre of Mühldorf, Germany (JVA Mühldorf), Zaki has been deported to Afghanistan.

The following statement and summary of the events has been written with Zaki after the deportation, based on several phone calls between Germany and Afghanistan. Since February 1, 2016, Zaki was detained in the detention centre of Mühldorf am Inn (Germany), after the registry office (Standesamt) of Tirschenreuth had passed on his Afghan passport to the foreigner’s registration office (Ausländerbehörde). On February 8th, a first deportation attempt was carried out from the airport of Munich with Qatar Airlines, which has been abandoned after protests at the airport and by Zaki. On March 15, Zaki has been deported to Afghanistan – Even though a psychological assessment points to a serious illness, and he had not been eating for more than three weeks.

Despite his life-threatening health condition and spontaneous protest at Frankfurt airport and the office of the airline, Air India carried out the deportation.

Zaki has been deported, even though he tried for three years to marry his fiancée, who is a Norwegian citizen. Even though he is the father of two children living in Norway. Despite the fact that he lived in Europe for 14 years. Although he is integrated, speaks German, Norwegian and English, and has no criminal record.

From start to finish, the courts have not recognized Zaki’s capacity to contract marriage (“Ehefähigkeit”) and his single status (“Ledigkeit”). However, both have been clearly proved with numerous certificates issued by Norwegian and Afghan authorities, as well as statements made by Zaki and Zaki’s friends. This evidence has been outrightly ignored. This reflects the political will to conduct deportations to Afghanistan ruthlessly, under complete ignorance of applicable law: Zaki is deprived of his fundamental right protecting marriage and family, as well as legally binding factors impeding deportations such as serious health conditions.

On March 9, the Committee on Petitions of the Bavarian Parliament decided against granting Zaki a temporary leave, with the conservative CSU voting down the Bavarian Green party and SPD.

Apparently, the decisive factor that has been put forward has been his allegedly “illegal” entry, allegedly using a “false identity”. The fact that there are little means for refugees to enter Europe “legally” and that the great majority is forced to enter “illegally” is apparently not clear to a majority of the petitions committee.

Since February 21, Zaki had been on hunger strike. Another hunger striker had already been deported to Afghanistan on February 24. The day before his deportation, a fire erupted in his cell. The deportation couldn’t be stopped – Despite protests in the Frankfurt airport office of the deportation carrier, Air India, the serious health risk due to the hunger strike, and a smoke poisoning resulting from the fire.

Since the fire, the prison authorities of JVA Mühldorf have issued a general ban on visits. Additionally, detainees are no longer allowed to receive mail. Zaki didn’t receive mail from his friends and supporters before his deportation, even though this had been promised to him by prison officials. He has only been handed empty envelopes.

To raise awareness for the hunger strike and protest against the deportations, several solidarity actions took place

On February 26, anti-deportation activists occupied the entrance of the foreigner’s registration office (“Ausländerbehörde”) in Munich, chained themselves, and requested an immediate stop to the deportations.

On March 1, a solidarity rally took place at JVA Mühldorf. Zaki told us that he had been taken to another room, in order to prevent any communication with the protesters. Although detainees under immigration law have to be granted eased conditions to drop the “punitive character” of detention, the refugees are arbitrarily deprived of their fundamental rights by the bans on visits and mail. That way, the JVA makes access to appropriate social and legal counselling, as well as the contact with
the “outside world” impossible.

This crackdown on a peaceful protest in the form of a hunger strike is not only inhumane, but also unlawful. With the deportation of Zaki, who had been on hunger strike for 23 days, the authorities also put at risk his health and life.

Last but not least, the the general situation in Afghanistan continues to be life-threatening. Freedom of movement is everybody’s right! No one
is illegal!
