Am Samstag, den 19. Juni 2021 starb der Rom Stanislav Tomáš, in Tschechien, nach einem brutalen Polizeieinsatz durch drei Polizisten auf offener Straße. Der 46 jährige Rom Stanislav Tomáš wurde in Teplice umgebracht. Sechs Minuten lang kniete ein Polizist auf seinem Hals, danach war er tot. Rassismus tötet, überall. Lasst uns dagegen aufstehen. Überall.

European Roma Grassroots Organisations (ERGO) Network, together with other Roma and pro-Roma and antiracism civil society organisations, would like to express our sincere condolences to Stanislav Tomáš’s family and loved ones, and hope that justice will be swiftly served.
We therefore call for an independent, thorough and objective investigation into the death of Stanislav Tomáš, a Romani man from Teplice, Czech Republic, who died soon after two police officers kneeled on him to immobilise him.

We are greatly disturbed by the footage showing Stanislav’s last moments of life during a police attempt to detain him by employing excessive force.
The amount of constant pressure applied to Stanislav’s upper body, neck and nape are totally inadequate and disproportionate to the act of immobilizing and handcuffing a person. Moreover, the immobilising and pressure continued long after he was handcuffed, until after he stopped screaming and moving. While the video ended before knowing for certain if he was still alive before the ambulance arrived, we can see that he was silent and inert. However, in the preliminary statements by the police, they deny that the officer’s tactics could have caused or contributed to Stanislav’s death, claiming that he died in the ambulance. Moreover, they declared that, according to the preliminary autopsy report, they had reason to conclude that he was under the influence of a foreign substance of an amphetamine nature, and the autopsy discovered pathological changes to the coronary arteries of the heart. Regardless of these circumstances, the actions of the police officers were thoroughly unjustifiable and disproportionate, and an abuse of power.

It is concerning that high-ranking Czech government officials, particularly the Minister of Interior and the Prime Minister, have backed the police officers when their role is to remain impartial and await the results of the official investigation into the case, allowing the justice system and those directly involved in the investigative process to do their job. Moreover, the Prime Minister rushed to conclude that Stanislav did not die as a result of the police intervention, based only on preliminary autopsy results, without waiting for the final results of the investigation process. Both officials also characterized Stanislav in derogatory ways to justify the police action and methods.

Establishing moral hierarchies about who should be protected before the law or about the level of a police response based on moral judgments and characterizations is very dangerous, especially coming from the highest level of the Czech political leadership and would constitute a violation of the police code of conduct and responsibilities. Police, especially in democratic societies and in the European Union, are there to serve and protect, regardless of the circumstances of a situation or the persons involved. In this particular case, there is no evidence proving that the person posed any immediate threat to himself and / or others, and therefore the use of excessive force and constant pressure on his windpipe was neither legitimate, nor proportionate.

We urge the EU institutions to call for an an independent, effective and unbiased investigation into the situation, so that the police officers are thoroughly and duly investigated and sanctioned proportionately per the level of offense and harm perpetrated.

We are also calling attention to the need to protect the privacy and safety of eyewitnesses, including shielding them against potential threats from non-state actors and police, if they are willing to be a party in the investigation and / or court hearings.

It is crucial that the investigation into the police intervention also takes into account racial motivation, in line with European Court of Human Rights jurisprudence.

We call on the EU leadership, the Czech Government, the media and non-governmental actors to take a clear stance against antigypsyism and police violence, including in their public statements. Moreover, we call on state officials and the Czech media to refrain from blaming the victim and stigmatizing his family and loved ones. The focus should remain on the adequacy of the police response or lack thereof leading to the passing of Stanislav, and nothing else.

We call on the Czech Parliament, the Public Defender of Rights, and other responsible institutions to start an investigation into the biased, derogatory, public statements and possible related actions by the Prime Minister and Interior Minister vis-a-vis this case.

We call on the EU institutions to launch a European-wide review of nationally-recommended police techniques and methods, including whether the authorized methods for immobilizing and detaining someone include using the method of kneeling on the neck and to work with Member States to ban dangerous methods that can cause irreversible harm or death.

As human rights defenders, we take a strong stance against police violence and inadequate police response, particularly when interacting with people from racialised minorities.

Roma Lives Matter!

Background

Amateur video footage was posted to Facebook on Saturday, 19 June featuring troubling images of the arrest of a man by three police officers in front of a group of bystanders who were visibly worried for the man’s safety, as he was kept immobilized by the application of continuous pressure to his neck and nape area for several minutes.

According to the spokesperson for the emergency rescue services in the Ústecký Region, Prokop Voleník, a scuffle had been reported between two people who were under the influence of narcotics at the time. “When the police patrol arrived at the scene, one of the men fled while the other was subdued by the officers and handcuffed,” police spokesperson Veronika Hyšplerová told the tabloid news server Blesk.cz. Police declared that the officers called an ambulance because the arrested man was under the influence of drugs.
Police spokesperson Daniel Vítek stated that “According to the preliminary autopsy report, there was reason to suspect the man had been under the influence of a foreign substance of an amphetamine nature, and the autopsy discovered pathological changes to the coronary arteries of the heart.” According to police, Stanislav Tomáš collapsed and subsequently died in the ambulance called to the scene.
Czech Prime Minister Andrej Babiš, who also chairs the Czech Government Council for Romani Minority Affairs, declared that “The court autopsy has clearly demonstrated that he did not die due to the intervention by police. This is sad, but a normal, respectable person would have a hard time getting into such a situation.” He backed the police officers in Teplice and thanked them for their intervention against Stanislav Tomáš. “If somebody destroys a car, is aggressive, and even bites a police officer, he cannot expect to be handled with kid gloves,” the PM commented.

Prior to the statement made by the Prime Minister, Czech Interior Minister Jan Hamáček also backed the police officers. “The intervening police officers have my full support. Anybody under the influence of addictive substances who breaks the law has to count on the police intervening. It is mainly thanks to the work of policemen and policewomen that we are among the top 10 safest countries in the world,” Hamáček commented in response to a police tweet insisting the Teplice incident is not an example of a “Czech George Floyd”.
Looking at the amateur footage, we can observe at second 0.6 the three police officers trying to immobilise a man who was already prone on the ground and who was resisting the way he was being handled, under the close scrutiny of a bystander. In about 10 seconds, two police officers manage to immobilise the man by sitting on him and using a lot of physical pressure: one police officer was positioned at the man’s head, pushing his left knee first onto his head against the pavement, and his right leg laterally and partially on his back, while bringing his hands together behind his back to place them in handcuffs with the help of the third officer, who also kneeled on the man’s back horizontally. The second officer, at first, just sat on the man’s leg, placing his whole-body weight onto his leg and then briefly changed into a kneeling position, using his left knee to press against both of the man’s knees while keeping his ankles still. In less than 1 minute, the third officer managed to place the handcuffs around the man’s wrists, but the two police officers continued to kneel on him, applying strong bodily pressure, despite the fact that he was already handcuffed. The police officer kneeling on the man’s legs then used his police phone (probably calling the ambulance) while continuing to press with both knees on the man’s legs; simultaneously the first police officer continued to apply pressure to the upper part of the man’s body and his right shoulder using his left arm, as well as on his coccyx using his right arm, while pushing his left knee onto his nape and neck, with his right knee probably pressed into the man’s back as well. At this point, people from the adjacent buildings started to scream and signal to the police officers, visibly concerned at the whole scene as it unravelled. Three minutes into this constantly-applied pressure, the second officer stood up while the first officer continued to apply the same pressure to the upper part of the man’s body, including his windpipe. Two passers-by came very close to the scene, one kneeling and trying to get a closer look at the man’s face and to talk to him, it seems. Around 4 minutes and 30 seconds into the video, the third police officer approached and again kneeled on the man’s right leg from the side, while applying pressure with his hands on his left leg. Five minutes into the intervention, the immobilised man stopped screaming or fighting visibly in the footage. After another 30 seconds, the first police officer finally removed himself from the man’s upper body, kneeling next to him instead and seemingly checking his breathing. The footage ended before we could understand if the man was still breathing and alive before the ambulance arrived.

Czech attorney Miroslav Krutina stated on the CNN Prima News channel’s 360° program that “Kneeling is quite a dangerous instrument”, adding that “if it were to be demonstrated that the kneeling was directly on the nape of the neck or on the neck itself, then it would not be proportionate.” He affirmed that he has consulted the Police Academy that trains officers in such methods. “Kneeling that would aim for the neck decidedly does not belong among the range of safe procedures. The reason is that it’s difficult to control the force of the pressure exerted,” he said, adding that in tense moments the technique can cause serious injury or strangulation.
According to Ondřej Moravčík, spokesperson for the Police Presidium, officers must pay attention to the principles of legality and proportionality when intervening. “The officer must assess the situation and decide which means of force will make it possible to achieve a purpose that is lawful and essential to overcome the resistance or the escape of the person being intervened against,” Moravčík previously explained to news server Aktuálně.cz.
At the close of the video that was published on social media, it can be seen that the man stops making any movements or sound. “If the person is quiet, stops shouting, stops moving, then it would be time to start testing his vital signs,” news server Romea.cz reported that a police trainer said while watching the closing phase of the video of the police intervention, when Stanislav Tomáš has stopped moving and shouting.
Reporter Richard Samko, who watched the footage together with the police instructor, asked him whether the officers actually proceeded correctly if the video shows that the man had not been moving for about 30 seconds while the officer’s knee remained on his neck; the instructor said: “The patrol is beginning to examine what’s going on with him. He isn’t communicating anymore, but we can’t assess what happened there, what kinds of pressures were exerted.”
Unfortunately, the death of George Floyd, an African-American man subjected to a similar police approach in the USA, has not yet led to a ban of the police technique of using the knee on someone’s neck across all European countries, despite European wide outrage and follow-up European Parliament resolution. However, after the death of George Floyd, police officers in France stopped using the manoeuvre and have also stopped teaching it at their police academies. “During arrests it will be forbidden to apply pressure to the neck or nape of the neck,” the then-Interior Minister of France, Christophe Castaner, announced at the time.

Monika Šimůnková, the Czech Deputy Public Defender of Rights, has announced in an interview for ROMEA TV that she will be investigating Saturday’s intervention by the police patrol in Teplice after which 46-year-old Stanislav Tomáš, a Romani community member, died. “After watching the video of the intervention in Teplice and reading all of the available information, I’ve decided to use my competencies and the scope of activity made possible by the law on the Public Defender of Rights with respect to the Police of the Czech Republic to begin an investigation on my own initiative,” she told ROMEA TV. “This investigation will focus on the proportionality of the methods of force used during the intervention in Teplice,” Šimůnková said. According to her, the investigation will be launched in the next few days and the results will depend on how quickly the Czech Police provide her office with the relevant materials. “I don’t dare predict the timeframe, it could be weeks, it could be months. I am bound by my duty to maintain confidentiality until the case is closed and the entire matter has been investigated, but I will try to conduct this investigation as quickly as possible,” she said.

The Council of Europe (CoE) also published a statement on 23 June, “calling for an urgent, thorough, and independent investigation into the recent death of a Romani man in the Czech Republic after he had been apprehended by the police. Footage taken on 19 June from Teplice, Czech Republic, showing police intervention against a Romani man who later died in an ambulance is alarming and raises numerous questions about the circumstances of this tragic incident,” the statement by the Spokesperson of the Secretary General reads.

Berlins Innensenator präsentiert sich im Vorwahlkampf als Hardliner in Punkto Abschiebungen. Ob Guinea, Afghanistan oder die Republik Moldau, vom Koalitionsversprechen einer humanen Abschiebepolitik ist viereinhalb Jahre später nichts mehr übrig.

Mit der durch einen medienwirksamen öffentlichen Auftritt im Görlitzer Park unterstützten Einladung einer fragwürdigen Guineischen Delegation zur Ausstellung von Abschiebedokumenten[1] und der Beteiligung Berlins an der bundesweiten Massenabschiebung am 16.3. nach Guinea ist in der Berliner Guineischen Community Panik ausgebrochen.

Wir gehen davon aus, dass diese Situation bei dem in Berlin lebenden geflüchteten Alpha Oumar Bah aus Guinea dazu geführt hat, dass er den psychischen Druck nicht mehr aushielt und sich in der Nacht von Dienstag auf Mittwoch das Leben nahm. Der 27jährige lebte seit mehr als drei Jahren in Berlin in einer Geflüchtetenunterkunft, hatte eine Duldung und verdiente seinen Lebensunterhalt bei einer Reinigungsfirma. Wir fordern eine genaue Aufarbeitung der Umstände seines Todes und dessen Zusammenhang mit dem psychischen Druck und der Ausweglosigkeit durch die aktuelle Berliner Abschiebepolitik.

Wir fordern den Innensenator auf, statt sich im Vorwahlkampf zu Lasten von geflüchteten Menschen mit  Abschiebungen zu profilieren, endlich funktionierende Legalisierungs- und Bleiberechtsregelungen umzusetzen, um den betroffenen Menschen eine Perspektive zu bieten, statt rassistische Ressentiments zu fördern.

In 2020 haben sich bundesweit die Abschiebezahlen infolge der Corona-Pandemie mehr als halbiert. Berlin ist als einziges Bundesland auf dem Niveau des Vorjahrs geblieben und hat  2020  fast 10 % der Abschiebungen bundesweit zu verantworten.[2]

Berlin organisiert  monatlich Massenabschiebungen in die Republik Moldau. Betroffen sind zum Großteil Rom*nja, welche in dem Corona gebeutelten Land weder Perspektive noch einen Zugang zu Gesundheitsversorgung haben. Trotzdem schob Berlin sogar Menschen im Rollstuhl, in laufender Chemotherapie oder in Tuberkulosebehandlung nach Moldau ab, ohne dass dort eine Weiterbehandlung gewährleistet ist.[3] Bei den bundesweiten Abschiebungen nach Afghanistan beteiligt sich Berlin an fast jedem Charter, so mit der Abschiebung eines jungen Mannes aus der Jugendstrafanstalt in Anstaltskleidung und ohne Geld[4] oder der eines Opfers von gewalttätiger Hasskriminalität .[5]

Wir fordern den Senat auf, den Koalitionsversprechen aus 2016 gerecht zu werden: Stopp der polizeilichen Panikmache – Weg von Abschiebungen – Hin zu Bleiberecht.

Seit einem Jahr gefährdet die Pandemie das Leben und die Existenz aller Menschen. Jedoch ist das Leben aller Menschen nicht in gleicher Weise und gleichermaßen erschwert. Tagtäglich geht die Schere zwischen Armen und Reichen auseinander. Die Regierungen interessieren sich nur für die riesigen Firmen.
Uns Flüchtlinge trifft Corona besonders hart. Vor allem unsere Schwestern und Brüdern, unsere Kinder, die unterwegs an den Grenzen Europas auf der Suche nach einem sicheren Ort sind, leben in einem Albtraum. Unsere Familien und Bekannte, die wir in unseren Herkunftsländern zurücklassen mussten, sind neben der Pandemie vielleicht durch Kriege oder den wirtschaftlichen Folgen der Pandemie oder Sanktionen zusätzlich betroffen. Sie kämpfen jeden Tag um ihr Überleben. Vielleicht sind sie auch der Verfolgung durch die diktatorischen Regime betroffen, welche ihnen verbieten, sich zu organisieren und für ihre Rechte als Arbeiter*innen, Frauen, Schüler*innen und Studenten*innen oder Lehrer*innen einzutreten.
Wir wollen aus verschiedenen Aspekten die Lage für uns analysieren und zusammen diskutieren: Wie ist es in Deutschland ein Flüchtling zu sein? Unter welchen Lebensbedingungen leben wir hier? Mit welchen Ungerechtigkeiten sind wir konfrontiert? Was können wir gemeinsam machen? Da wir weder reisen noch uns treffen können, wollen wir virtuelle Räume anbieten, um uns auszutauschen, gemeinsame Diskussionen zu führen und Wege suchen, wie wir unsere Rechte verteidigen können. Falls euch andere Themen wichtiger erscheinen und ihr mit solidarischen Gemeinschaften diskutieren und Lösungen entwickeln wollt, so nennt uns diese Themen. Gemeinsam schauen wir über auf 500 Jahre Widerstand gegen Kolonialismus, Imperialismus und Unrecht und können unsere Erfahrungen solidarisch in die zukünftigen Kämpfe einbringen, unabhängig von Herkunft, Sprache, Religion, Geschlecht, Alter, …

Wer sind wir?

Wir sind die KARAWANE für die Rechte der Flüchtlinge und MigrantInnen. Wir organisieren uns und kümmern uns gemeinsam um unsere Anliegen. Wir kämpfen seit 1998 in Deutschland für unsere Grundrechte, gegen Abschiebungen, gegen Ausbeutung, gegen Rassismus, gegen Isolation und Polizeibrutalität und gegen jedwedes Ungerecht… Die Parole „Wir sind hier, weil ihr unsere Länder zerstört“ begleitet uns seit unserer Existenz, weil die weltweite koloniale und imperialistische Ordnung unsere Leben bestimmt und uns zur Flucht zwingt. Dagegen lehnen wir uns überall auf und stärken uns durch solidarisches Handeln.
Seit 2004 sind wir zusammen mit der Föderation der ArbeitsmigrantInnen aus Türkei AGIF und anderen MigrantInnen-Selbstorganisationen in Wuppertal kontinuierlich aktiv. Vor Corona hatten wir ein wöchentliches offenes Treffen. Dies ist nunnicht mehr möglich, daher organisieren wir nun Online-Treffen.

Corona hits us refugees particularly hard. Above all, our sisters and brothers, our children, who are on the move at the borders of Europe in search of a safe place, are living in a nightmare. Our families and acquaintances whom we have had to leave behind in our countries of origin are, in addition to the pandemic, perhaps additionally affected by wars or the economic consequences of the pandemic or sanctions. They are struggling to survive every day. Maybe they are also affected by the persecution of dictatorial regimes that forbid them to organise and stand up for their rights as workers, women, pupils and students or teachers.
We want to analyse the situation from different aspects and discuss it together: What is it like to be a refugee in Germany? Under which living conditions do we live here? What injustices are we confronted with? What can we do together? Since we can neither travel nor meet, we want to offer virtual spaces to exchange, have joint discussions and look for ways to defend our rights. If other issues seem more important to you and you want to discuss and develop solutions with communities in solidarity, please tell us about them. Together we can look back on 500 years of resistance against colonialism, imperialism and injustice and bring our experiences into future struggles in solidarity, regardless of origin, language, religion, gender, age, …

Who are we?

We are CARAVAN for the rights of refugees and migrants. We organise ourselves and take care of our concerns together. Since 1998, we have been fighting in Germany for our basic rights, against deportations, against exploitation, against racism, against isolation and police brutality and against any kind of injustice… The slogan “We are here because you are destroying our countries” has accompanied us since our existence, because the global colonial and imperialist order determines our lives and forces us to flee. We rebel against this everywhere and strengthen ourselves through solidarity action.
Since 2004, we have been continuously active together with the Federation of Migrant Workers from Turkey in Germany AGIF and other migrant self-organisations in Wuppertal. Before Corona we had a weekly open meeting. This is no longer possible, so we now organise online meetings.

Aufruf zum dezentralen Gedenken im Rahmen der (Corona-)Möglichkeiten

Unser Bruder Oury Jalloh wurde am 07.01.2005 (RIP) von Polizisten auf dem Dessauer Polizeirevier in Gewahrsam bis zur Unkenntlichkeit verbrannt. Durch unabhängige Gutachten und Aufklärungsarbeit der letzten 15 Jahre konnte dies die Initiative mit faktischen Beweisen aufzeigen. Die deutsche Justiz verweigert sich weiterhin aufzuklären und verleumdet, dass Oury sich nicht selbst angezündet haben kann. Nicht zuletzt verkündeten dieses Jahr im August 2020 die Sonderberater des Landtages Sachsen-Anhalts, dass sie weiterhin an der Täterversion der Selbstanzündungsthese festgehalten und unseren Bruder Oury Jalloh weiterhin kriminalisieren. Wir wissen:

OURY JALLOH – DAS WAR MORD!

Und es ist kein Einzelfall! Im Oktober 2018 hat die Internationalen Unabhängigen Kommission zur Aufklärung des Todes von Oury Jalloh zwei weitere Mordfälle in die unabhängigen Untersuchungen mit aufgenommen: Hans-Jürgen Rose (1997 RIP) und Mario Bichtemann (2002 RIP) wurden beide in Polizeiobhut in Dessau zu Tode gefoltert. Deshalb reden wir vom OURY-JALLOH-KOMPLEX.

Am 7. Januar 2021 werden wir wie jedes Jahr unserem Bruder Oury Jalloh in Dessau gedenken. Und auch unserem Bruder Alberto Adriano (2000 RIP), der von Neonazis im Dessauer Stadtparkt zu Tode geprügelt wurde. Sowie Yangjie Li (2016 RIP), die von einem Dessauer Polizisten-sohn und dessen Freundin vergewaltigt und umgebracht wurde.

Wir wollen auch all unseren Geschwistern gedenken, die in Deutschland, Europa und auf der ganzen Welt durch rassistisch motivierte Gewalt von Polizei und Nazis umgebracht worden, von Justiz und Staat entehrt und unterdrückt und von einer schweigenden Masse an Zivilbürger:innen in Deutschland vergessen werden.

Wir werden sie niemals vergessen! Wir werden nicht schweigen! Wir werden weiter kämpfen für Aufklärung, Gerechtigkeit und Konsequenzen!

drei Kindern in einer Geflüchteten-Unterkunft in Berlin-Moabit. Am
27.9.2016 kommt er bei einem Polizeieinsatz in Berlin ums Leben.
Die Polizei wird später von einem Messer in der Hand des Erschossenen
sprechen, um ihre Handlung als Notwehr zu rechtfertigen. Doch bisher ist gar nicht nachgewiesen, ob Hussam Fadl während des Tathergangs
tatsächlich ein Messer bei sich trug.
Seine Witwe Zaman Gate und ihr Rechtsanwalt Ulrich von Klinggräff
kämpfen um die gerechte Aufklärung der Wirklichkeit. Eine vielstimmige

Was ist in Ellwangen passiert? Ein Statement von den Geflüchteten in Ellwangen

Die Situation in Ellwangen begann schon vor der Razzia am vergangenen Donnerstag. Nämlich im April 2018:

„Wir haben uns mit dem Leiter der LEA in Ellwangen getroffen. Wir haben ihm über unser Leben in der Unterkunft und wie die Leute sich hier fühlen erzählt, auch wegen die Duldung und Dublin regeln.“

Er versprach uns, dass wir mit der Presse und mit PolitikerInnen über unsere Situation reden können, da er und die Hausverwaltung nicht für die Zustände verantwortlich seien. Er wollte sich um alles kümmern.

Am 27. April hatten wir dann ein gemeinsames Treffen mit dem Leiter der LEA. Bei diesem Treffen sagte er, wir könnten die Presse am Donnerstag, dem 03. Mai treffen.

Um 3 Uhr morgens am Montag, dem 30. April, hörten wir viel Lärm. Als wir draußen ankamen, beschwerten sich Leute über die Abschiebung eines Togolesen. Wir sahen, dass die Polizei den Mann zwingen wollte, in ihr Auto einzusteigen – er war bereits in Handschellen. Und er sagte zur Polizei, dass er nicht einverstanden sei. Also sagten auch wir, dass wir die Polizei den Mann nicht einfach aus der Unterkunft mitnehmen lassen. Als sie sahen, dass immer mehr Leute von der Unterkunft nach draußen kamen, zogen sie sich zurück.“ Wir waren zu dem Zeitpunkt um die 30/40 Leute.“ Das berichten die Geflüchteten aus Ellwangen. Die Polizei war schon weg, als noch weitere Geflüchtete zum Ort des Geschehens kamen. Sie trafen nur noch den Mann in Handschellen an, während wir ihnen von der Situation erzählten.

Die Berichterstattung schreibt nun von bis zu 200 Personen. Doch in der Unterkunft in Ellwangen sind aktuell weniger als 150 afrikanische Geflüchtete untergebracht. Wenn der Vorwurf, dass wir die Polizei umringt hätten, stimmen würde, wie wäre es ihnen dann überhaupt möglich gewesen, sich so unproblematisch zurückzuziehen? Wenn die Polizei sich so sicher ist, sollten sie doch in der Lage sein, Beweise dafür anzubringen. Die deutsche Polizei ist – wie wir wissen – sehr professionell im berichten über ihre Kontrollmacht.

An dieser Stelle scheint der Rassismus der deutschen Polizeibehörden ihnen selbst auf die Füße zu fallen. („Oh, afrikanische Geflüchtete, die sind aggressiv.“)

„Nach einer Stunde kam ein Security Mitarbeiter mit dem Schlüssel der Handschellen, befreite den Mann und ging mit den Handschellen wieder.
Wir waren überrascht, als dann gegen 10:00 Uhr morgens, nochmal der Einrichtungsleiter zu uns kam und uns aufforderte, ihm die Handschellen zu geben. Wir fragten: „Why are you trying to fool us when the handcuff is with the security officer?“ Wir gingen danach zum Security Mitarbeiter, der die Handschellen mitgenommen hatte. Wir fragten ihn, warum er den Einrichtungsleiter nicht über den Verbleib der Handschellen informiert hatte, woraufhin dieser erwiderte, dass der Einrichtungsleiter bereits informiert wurde.“

An dieser Stelle war uns klar, dass etwas falsch läuft. Erpressung und Intrigen, um uns ungerechtfertigter Weise zu kriminalisieren.

„Am Donnerstag, dem 3. Mai, um 5:00 Uhr morgens – also an dem Tag, an dem wir die Presse hätten treffen sollen (was vom Einrichtungsleiter organisiert wurde) – hörten wir Schreie und Rufe: „Polizei! Polizei!“ Die Polizei brach sämtliche Zimmertüren gewaltsam auf (obwohl man die Türen in der Einrichtung nicht abschließen kann), stürmte die dunklen Zimmer mit hellen Taschenlampen und schrie, „Polizei! Polizei! Hands up, don`t move! Give me your Ausweis and Camp chip card! Do you have a handy?“ Daraufhin wurden wir mit Kabelbindern gefesselt und sollten uns auf den Boden legen. Nach der Kontrolle der Ausweise und der Camp-Chipkarten, um die Personen zu identifizieren, ging die Polizei weiter und durchsuchte unsere Kleidung und gesamten Zimmer. Davor fragten sie uns noch, ob wir irgendwelche gefährlichen Waffen oder Drogen in unserem Besitz hätten. Einige von uns waren nackt und ihnen wurde verboten, sich etwas anzuziehen – auch trotz Erkältungen. Wir wurden gezwungen ruhig zu sein und wir wurden geschlagen, wenn wir es gewagt haben, Fragen zu stellen. Unsere Hosen und Geldbeutel wurden durchsucht. Von einigen von uns, die mehr als 200,- Euro hatten, nahmen sie Geld mit.

Nach der Razzia wurden 27 Personen festgenommen und in ein anderes Gebäude, gegenüber der Polizeistation auf dem Gelände der Unterkunft, gebracht. Eine der betroffenen Personen, die verhaftet wurde, weil sie unregistrierte Lyca Simkarten hatte, erzählt, wie schlecht sie behandelt wurden, gefesselt und in der Kälte stehen gelassen.

Eine junge Frau, die ihrem Partner Kleidung brachte, durfte ihm nicht helfen, Klamotten zu tragen. Aber ein anderer festgenommener und gefesselter Freund half ihm, während die Polizei sie beobachtete. Einem anderen Freund von uns wurde vom Polizeichef untersagt, die Toilette zu benutzen. Der gleiche Polizeichef befragte einen anderen Polizeibeamten, warum ein Geflüchteter ohne, mit Kabelbindern, verbundenen Händen in die Schlange der Festgenommenen gebracht wurde. Er ordnete an, auch diesen Geflüchteten zu fesseln.

Einer nach dem anderen wurde verhört – im Dabeisein von fast 20 Polizeibeamten mit Hunden. Außerdem wurden wir fotografiert und danach in die Polizeistation auf dem Unterkunftsgelände gebracht, wo uns Fingerabdrücke abgenommen wurden. Selbst einer der Sozialarbeiter war schockiert, dass ein solcher Prozess losgetreten wird, beispielsweise aufgrund des Besitzes von SIM-Karten.

Als die Polizei schließlich weg war, gab es einige Verletzte, die ins Krankenhaus kamen. Zur gleichen Zeit begannen einige Medien, von außerhalb der Unterkunft aus, zu berichten.
Wir sind erschüttert, wie die Medien die erlogenen Polizeiberichte einfach übernommen haben, ohne die tatsächlichen Ereignisse zu recherchieren oder uns zu fragen, was passiert ist.

Wir, die Geflüchteten aus Ellwangen, sind nicht gewalttätig. Auch wenn die Polizei sagt, wir hätten sie angegriffen. Es gab während des Vorfalls eine Distanz zwischen uns und der Polizei. Unser Bruder in Handschellen stand zwischen uns und der Polizei. Wir haben Beweise für alles, was die Polizei mit uns gemacht haben.

Jetzt haben wir uns entschieden, eine Demonstration zu machen. Für uns ist das die einzige Möglichkeit, Leute darüber zu informieren, was tatsächlich passiert ist. Die Medien verfälschen unsere Statements und wenden sie gegen uns.

Wir treffen uns am Mittwoch, dem 9. Mai um 17:00 Uhr an der Ellwangener LEA.

Statement by the refugees from #Ellwangen, Germany on police-raid

Dear Friends and Friends

The situation in Ellwangen began even before the Razzia last Thursday. Namely, in April 2018:

“We met with the head of the LEA in Ellwangen. We told him about our life in the accommodation and how people feel here, also about of the systems of “Duldung” and “Dublin”.

He promised us that we could talk to the press and politicians about our situation, as he and the property management were not responsible for the conditions. He wanted to take care of everything.

On April 27th we had a joint meeting with the head of the LEA. At this meeting he said we could meet the press on Thursday, May 3rd.

At 3 a.m. on Monday, April 30th, we heard a lot of noise. When we got outside, people complained about the deportation of a Togolese. We saw that the police wanted to force the man to get into her car – he was already handcuffed. And he told the police that he disagreed. So we also said we wouldn’t let the police just take the man out of the accommodation. As they saw more and more people coming out of the house, they withdrew.” We were about 30/40 people at the time.” That’s what the refugees from Ellwangen report. The police already had left when more refugees came to the scene. They only met the man in handcuffs while we told them about the situation.

Media coverage now covers up to 200 people. However, less than 150 African refugees are currently accommodated in the accommodation in Ellwangen. If the accusation that we surrounded the police were true, how would they have been able to withdraw so easily? If the police are so sure, they should be able to provide evidence. The German police is – as we know – very professional in reporting about their control power.

At this point, the racism of the German police authorities seems to be falling on their own feet. “(“Oh, African refugees, they’re aggressive.”)

“After one hour, a security guard came in with the keys to the handcuffs, freed the man and left with the handcuffs. We were surprised when around 10:00 o’clock in the morning, the manager came to us again and asked us to give him the handcuffs. We asked: “Why are you trying to fool us when the handcuff is with the security officer?” We went to the security guard who took the handcuffs. We asked him why he had not informed the head of the facility about the whereabouts of the handcuffs, whereupon he replied that the head of the facility was already informed”.

At this point it was clear to us that something was going wrong. Extortion and intrigues to criminalize us unjustifiably.

“On Thursday, May 3rd, at 5:00 a.m. – the day we should have met the press (organized by the director of the facility) – we heard screams and shouts: “Police! Police!” The police forcibly broke open all the room doors (although the doors in the facility cannot be locked), stormed the dark rooms with bright flashlights and shouted, “Police! Police! Hands up, don`t move! Give me your ID and Camp chip card! Do you have a mobile?” Then we were tied up with cable ties and were supposed to lie down on the floor. After checking the identity cards and camp chip cards to identify the people, the police went on and searched our clothes and entire rooms. Before that, they asked us if we had any dangerous weapons or drugs in our possession. Some of us were naked and were forbidden to put anything on – even with colds. We were forced to be quiet and we were beaten when we dared to ask questions. Our pants and wallets were searched. They took the money away from some of us, who had more than 200,- Euro.

After the raid, 27 people were arrested and taken to another building opposite the police station on the premises of the accommodation. One of the people who was arrested for having unregistered Lyca Sim cards tells how badly they were treated, tied up and left out in the cold.

A young woman who brought clothes to her partner was not allowed to help him wear clothes. But another arrested and tied friend helped him while the police watched her. Another friend of ours was forbidden to use the bathroom by the police chief. The same police chief asked another police officer why a refugee was brought into the line of those arrested without their hands tied with cable ties. He also ordered this refugee to be tied up.

One by one was interrogated – in the presence of almost 20 police officers with dogs. We were also photographed and then taken to the police station on the accommodation site, where fingerprints were taken. Even one of the social workers was shocked that such a process was being kicked off, for example because of the possession of SIM cards.

When the police finally left, there were some wounded who came to the hospital. At the same time some media began to report from outside the accommodation.
We are shocked at how the media have simply taken over the lying police reports without researching the actual events or asking ourselves what happened.

We, the refugees from Ellwangen, are not violent. Even if the police say we attacked them. There was a distance between us and the police during the incident. Our brother in handcuffs stood between us and the police. We have evidence of everything the police have done to us.

Now we have decided to make a demonstration. For us, this is the only way to inform people about what actually happened. The media falsifies our statements and turns them against us.

 

A Very Big SALUTE to the Refugee Resistance in Ellwangen

With a strong and powerful fist raised towards the sky, we The VOICE Refugee Forum salute the bravery and courage of our fellow refugee brothers and sisters, for valiantly preventing the callous and inhuman deportation of a Togolese refugee and defending his right to human dignity.

Since the incident last Monday and the unsubstantiated Police allegation of “attack and violence” by refugees, the German mainstream and tabloid media have literally gone into overdrive to report on it. Yet, they are unable to report what the refugees are saying and experiencing. Any surprise? Not at all, because this is obviously an attempt to broaden and advance the underlying anti-refugee politics and policies of the German government, deliciously but dangerously spiced with racist motives and narratives. The press is refusing to report on the unhealthy, horrible and unbearable conditions that refugees are forced to live in, where refugees are crammed together like slaves on slave ships. They are failing to report that refugees are being deported with violence by the German authorities to countries (including Italy and others in Europe and beyond) where neither the safety of their lives nor their human dignity can be guaranteed. Is it any wonder that attempted and actual suicide by refugees are on the increase as a result of the hopelessness and lack of perspectives they are served with in this “Rechtsstaat”? Where is the press on these issues? There is a deafening silence!

Yes, rechtsstaat! The feckless politicians are head over heals tripping themselves on the way to see who can wear the badge of ‘the nastiest’ to the refugees. They are racing to the rotten bottom in condemnation of a legitimate resistance to oppression, violence and inhumanity in the name of rechtsstaat and hospitality that ‘must not be trampled on’. How cynical, disingenuous and hypocritical of you to even mention rechtsstaat and hospitality with your ‘lager’ mentality and how you treat refugees in those filthy camps. We are not even going into your shameless, dubious and corrupt collaboration with dictators all over Africa including Togo where this refugee fled from in the first place. You are so upright with your rechtsstaat that you reach agreements with and pay these dictators who in turn employ militias to brutalise and maim men, women and children seeking refuge from the dangerous situation that you facilitate with your economic interests. If the experience in these camps is what you define as hospitality, we heartily invite you to check into one of these camps (yes, there is still enough space for you and your family) and enjoy it. If you are too cowardly to take that offer, we ask you in very clear terms to take your hospitality and shove it!!!

The allegation of aggression, attack and violence by the police as widely reported in the media is so far, nothing more than a bogus claim as there is up till the moment of writing, no evidence to substantiate those claims. While the police managed to mis-inform and the press ran with the misinformation that the refugees injured scores of police officers – supposedly, officially the Police could only confirm that only one officer was slightly injured (see Taz, 3.5.18 “Was geschah in Ellwangen?” www.taz.de/!5500584/). Worse still is the allegation of weapons that the refugees supposedly had which also turned out to be flatly false. Unable to prove that the refugees were violent as alleged, the Police resorted to redefine and equate violence with coercion. Perhaps the Police need to be reminded of what violence is: violence is when you chained Oury Jalloh to the mattress in a police station in Dessau and burned him alive. Violence is when you forcibly pumped emetics into Laye Conde and killed him in a police station in Bremen, just as Achidi John in Hamburg. Violence is when you fatally shot Dominique Kumadio near his apartment in Dortmond just like you shot and killed Christie Schwundeck at the Job Centre in Frankfurt, and Mariamme Sarr in Ascherffenburg. Violence is when policemen raped women (who were to be deported) and filmed it, in police station in Bremen. Got it? The list goes on!!!

In our view, two things are particularly worth noting here. First, it is important to put these into some perspectives and understand that this is a carefully pre-planned and coordinated effort by the authorities to break the resistance of refugees to deportation. Moreover, it is to provide a political cover, legitimisation and justification for the unwarranted violence and brutality that the police are most likely to exert in any future deportation attempts. They have admitted this much in public and their action on Thursday confirms this. But it remains to be seen if the public will rise in support of human decency and respect of the vestiges of refugee rights in this country or they will submit to manipulation and be conned by these sinister machinations. For anyone who has been invested in any way in the pervasive and now-fading refugees welcome, it is time to shed that superficiality and get real and show some solidarity with these maligned refugees.

Second, there is nothing criminal about the desire to live a safe and secured life irrespective of how Germany and others may view it today. Millions of people migrated from Germany/Europe to seek better and secured lives in other countries and continents and so it is nothing new. Refugees are in this country exactly for this reason and “We are here because you destroy our countries”!!! So any attempt to deny us the opportunities to realise this is sure to be met with resistance. This is why refugee resistance is guaranteed to continue in Germany irrespective of the politics and policies of the German/European authorities or the number of policemen and women and their vehicles. It is in this spirit of resistance that we SALUTE the courageous action of refugees in Ellwangen.

SALUT dem Flüchtlingswiderstand in Ellwangen

Mit einer starken und machtvollen zum Himmel gereckten Faust begrüßen wir, The VOICE Refugee Forum, die Tapferkeit und den Mut unserer Mitflüchtlinge, Brüder und Schwestern, weil sie beherzt die hartherzige und inhumane Abschiebung eines togoischen Flüchtlings verhindert und sein Recht auf Menschenwürde verteidigt haben.

Seit dem Vorfall letzten Montag und der substanzlosen Anschuldigung von “Angriff und Gewalt”, die von Flüchtlingen ausgegangen sein sollen, haben die deutschen Mainstream- und Boulevardmedien im wahrsten Sinne des Wortes die Automatikschaltung eingelegt, wenn sie darüber berichteten. Ja, sie sind nicht in der Lage, darüber zu berichten, was die Flüchtlinge sagen und welche Erfahrungen sie machen. Überraschung? Absolut nicht, denn dies ist offensichtlich ein Versuch, die zu Grunde liegende Anti-Flüchtlingspolitik und die Politik der deutschen Regierung delikat und gefährlich gewürzt mit rassistischen Motiven und Narrativen auf eine breitere Basis zu stellen und voranzutreiben.

Die Presse weigert sich, über die ungesunden, schrecklichen und unerträglichen Bedingungen zu berichten, unter denen Flüchtlinge zu leben gezwungen sind, wo Flüchtlinge zusammengepfercht werden wie Sklaven auf einem Sklavenschiff. Sie versäumen es, darüber zu berichten, dass Flüchtlinge von den deutschen Behörden gewaltsam in Länder (einschließlich Italien und andere europäische Staaten) abgeschoben werden, wo weder die Sicherheit ihres Lebens noch ihre Menschenwürde garantiert werden können. Ist es in irgendeiner Weise verwunderlich, dass versuchte und tatsächliche Selbstmorde von Flüchtlingen zunehmen als Resultat der Hoffnungslosigkeit und des Mangels an Perspektiven in diesem “Rechtsstaat”? Wo ist die Presse bei diesen Angelegenheiten? Hier herrscht ohrenbetäubende Stille!

Ja, Rechtsstaat! Die nutzlosen Politiker überstürzen sich dabei, um zu sehen, wer die Plakette desjenigen tragen kann, der am fiesesten gegenüber den Flüchtlingen ist. Sie führen ein Wettrennen zum verkommenen Boden der Verurteilung eines legitimen Widerstandes gegen Unterdrückung, Gewalt und Unmenschlichkeit im Namen eines “Rechtsstaates, auf dem nicht herumgetrampelt werden dürfe”. Wie zynisch, verschlagen und heuchlerisch von euch ist es, sogar von Rechtsstaat und Gastfreundschaft zu sprechen angesichts eurer Lager-Mentalität und der Art und Weise, wie ihr mit den Flüchtlingen in diesen dreckigen Lagern umgeht.

Von eurer schamlosen, zweifelhaften und korrupten Kollaboration mit Diktatoren in ganz Afrika, einschließlich Togo, von wo dieser Flüchtling geflohen ist, sprechen wir hier gar nicht an erster Stelle. Ihr seid so aufrecht mit eurem Rechtsstaat, dass ihr Abkommen mit diesen Diktatoren erreicht und sie dafür bezahlt, dass sie im Gegenzug Milizen anstellen, um Männer, Frauen und Kinder zu brutalisieren und zu verstümmeln, die Zuflucht suchen von der gefährlichen Situation, die ihr durch eure ökonomischen Interessen gefördert habt. Wenn die Situation in diesen Lagern das ist, was ihr als Gastfreundschaft definiert, dann laden wir euch herzlich ein, in eines dieser Lager einzuchecken – ja, es gibt noch genug Platz für euch und eure Familien – und euren Aufenthalt zu genießen. Falls ihr zu feige seid, dieses Angebot anzunehmen, fordern wir euch in klaren Worten auf: Nehmt eure Gastfreundschaft und steckt sie euch sonstwo hin!

Die von der Polizei erhobenen Anschuldigungen von Aggression, Angriff und Gewalt, von denen in den Medien so ausführlich berichtet wurde, sind bislang nicht mehr als eine falsche Behauptung, da es bis zu dem Moment, in dem dieser Text verfasst wurde, keinen Beleg gibt, der diese Behauptungen mit Substanz füllen würde. Während es der Polizei gelungen ist, falsch zu informieren, und die Presse davongelaufen ist mit der Falschmeldung, dass die Flüchtlinge eine große Menge von Polizeibeamten verletzt hätte, konnte die Polizei offensichtlich offiziell lediglich bestätigen, dass nur ein Beamter leicht verletzt wurde
(see TAZ, 3.5.18 “Was geschah in Ellwangen?” www.taz.de/!5500584/). Schlimmer noch ist die Anschuldigung, dass die Flüchtlinge angeblich Waffen besessen hätten, die sich ebenfalls als rundweg falsch herausstellte.

Unfähig zu beweisen, dass die Flüchtlinge, wie behauptet, Gewalt anwandten, verlegte man sich darauf, den Begriff umzudefinieren und Nötigung mit Gewalt gleichzusetzen. Vielleicht muss die Polizei daran erinnert werden, was Gewalt ist: Es war Gewalt, als ihr Oury Jalloh in einer Polizeistation in Dessau an eine Matratze angebunden habt und ihn lebendig verbranntet. Es war Gewalt, als ihr Brechmittel in Laye Conde hineingepumpt habt und ihn dadurch in einer Polizeiwache in Bremen getötet habt, genauso wie Achidi John in Hamburg. Es war Gewalt, als ihr Dominique Kumadio in der Nähe seiner Wohnung in Dortmund erschossen habt, so wie ihr auch Christie Schwundeck auf dem Jobcenter in Frankfurt durch eure Schüsse getötet habt und Mariamme Sarr in Aschaffenburg. Es war Gewalt, als Polizisten Frauen, die abgeschoben werden sollten, vergewaltigten und dabei filmten, geschehen in einer Polizeistation in Bremen. Verstanden? Die Liste geht weiter!

Unserer Meinung nach sind insbesondere zwei Dinge hier nötig erwähnt zu werden. Erstens ist es wichtig, dies in die richtige Perspektive zu rücken und zu verstehen, dass es sich hier um ein von den Behörden sorgfältig geplantes und koordiniertes Bestreben handelt, den Widerstand von Flüchtlingen gegenüber Abschiebungen und ihre Solidarität miteinander zu brechen. Darüber hinaus dient es dazu, den politischen Deckmantel, die Legitimierung und Rechtfertigung für die ungerechtfertigte Gewalt und Brutalität zu liefern, die die Polizei höchstwahrscheinlich bei jedem zukünftigen Abschiebeversuch ausüben wird. Sie haben dies häufig öffentlich zugegeben und ihre Aktion am Donnerstag bestätigt dies. Aber man muss sehen, ob die Öffentlichkeit aufstehen wird, um den menschlichen Anstand und den Respekt gegenüber den Resten der Rechte von Flüchtlingen in diesem Land zu unterstützen oder ob sie sich der Manipulation unterwirft und durch diese dunklen Machenschaften hereingelegt wird. Für jeden, der in irgendeiner Weise in das einst allgegenwärtige und nun verschwindende “Refugees Welcome” einbezogen war, ist es jetzt Zeit, diese Oberflächlichkeit abzuwerfen und echt zu werden und Solidarität mit diesen verleumdeten Flüchtlingen zu zeigen.

Zweitens liegt nichts Kriminelles in dem Wunsch, ein sicheres und geschütztes Leben zu führen, unabhängig davon wie Deutschland und andere das heute sehen mögen. Millionen von Menschen emigrierten aus Deutschland/Europa, um ein besseres und sicheres Leben in anderen Ländern und Kontinenten zu suchen, also ist dies nichts Neues. Flüchtlinge sind genau aus diesem Grund in diesem Land und: “Wir sind hier, weil ihr unsere Länder zerstört!!!” Daher wird jeder Versuch, uns die Chancen zu verweigern, dies zu verwirklichen, mit Sicherheit auf Widerstand treffen. Aus diesem Grund wird der Widerstand von Flüchtlingen in Deutschland garantiert weitergehen, unabhängig von der Politik der deutschen und europäischen Behörden und unabhängig von der Anzahl der Polizisten und Polizistinnen und ihrer Fahrzeuge. Im Geiste dieses Widerstandes begrüßen wir die mutige Aktion der Flüchtlinge in Ellwangen.

Statement on police brutality in the reception center in Donauwörth on 14th of March

On Wednesday, 14th of March, police forces showed extreme brutality towards the inhabitants of the reception center and arrested at least 29 persons. This happened after a legitimate protest against an attempted deportation. The location of those who were arrested is still unclear. There was no violence against humans on the side of the refugees. The charges of “breach of peace” and “grievous bodily harm” are utterly unfounded and constructed and will need independent evidence.

Refugees and human rights organisations have been criticising the inhuman living conditions in the reception centre (EA) in Donauwörth for months. The minister of the interior, Herrmann, used the false accusations against refugees spread by police as a pretext to personally travel to Donauwörth on Friday to continue his electoral campaign with right wing demands such as more police and more deportations.

The refugees in the EA of Donauwörth have released a statement (see below), in which they reject the unfounded accusations against them, demand the release of the prisoners, the recognition of their asylum applications, working permits and protection from the police.

Antiracist innitiatives and human rights organisations are stating their solidarity with those involved and with their demands. In addition to this, these groups demand the dismissal of the social workers who have violated their mandate towards the refugees in the EA.

We, the refugees of Donauwörth, demand that the unfounded claims, that we used violence against the police and that we threw furniture out of the windows, are withdrawn immediately. The police came to deport our colleague and began knocking at the doors to all our rooms between 3 and 4 in the morning, as they could not find him in his own room. Around 100 people of different nationalities woke up and demanded with their voices to immediately stop the deportation. At around 2 pm more than 50 police vans and over 200 special police unit officers entered the camp armoured with pistols, tear gas, batons, knives, ropes, rifles, dogs and pepper spray. They locked us in our rooms and barred the main entrance. Everywhere in the house they blocked the passages while taking our personal details and searching our rooms. They were seeking at least 29 people with a list of names, which had been obtained that morning with the help of the social workers and security personell. They threw tear gas canisters into the camp and sprayed pepper spray into some rooms as well as into our eyes. Some people fainted, others jumped out of the windows to save themselves. Window panes had to be broken to allow fresh air to enter the rooms, as all the windows in the EA are locked.

The demands of our previous protests have been, and remain, the recognition of our asylum applications, the closing of the transit camps of transfer to private appartments and the right to participation. Furthermore we demand the release of the prisoners.

This year, Paris is seeing one of its coldest winters in decades. The masses of snow have caused traffic and public transport chaos and have left thousands of people sleeping rough —many of them migrants— in life-endangering conditions. At the same time, the Macron administration is planning a further neoliberalization of France’s universities and keeps tightening French asylum laws and criminalizing supporters. Recently, in Nantes, Grenoble, and Lyon, refugees, students, and people in solidarity have started occupying university buildings converging these struggles. At the end of January, students protesting planned changes to university access and migrants fighting for a right to stay, housing and an end to the Dublin regulations have also joined forces and occupied building A of university Paris 8/Saint Denis.
